Terms of Service

These terms govern your use of Pallas, the website and web app at this address (“Pallas”), operated by Centaurio UG (haftungsbeschränkt), Dr.-Rohmer-Weg 11, 65719 Hofheim am Taunus, Germany, represented by the Managing Director Valentin Weinert, email support@kairocalories.com (“we”). By creating an account or using Pallas you agree to these terms. Pallas is built for businesses, founders and freelancers who promote a product. If you use it as a consumer, the mandatory consumer rights of your country of residence remain unaffected.

You paste a link to your product and a budget. Pallas then:

• ·reads your product page to work out what it is and where it sells,
• ·searches public TikTok and Instagram profiles for creators who post about related topics,
• ·reads their recent posts and comment sections, ranks the ones that fit, and estimates what they cost against your budget,
• ·shows the contact path each creator published (email, link-in-bio or DM handle) and drafts a message you can send.

Pallas does not send messages, does not negotiate, does not pay creators and does not run campaigns. It is a discovery tool, not an agency or a marketplace. We do not act as an intermediary between you and any creator, and no contract with a creator comes about through Pallas.

You sign in with Google or with a link sent to your email. You must be at least 18 and keep your sign-in secure. One free search per person: do not create extra accounts to get more. You are responsible for what happens under your account. You can ask us to delete your account at any time by email; we do it within one month.

• ·Free: one search on the light pipeline, 10 creators, the contact and drafts of 3 of them. No card.
• ·Single search: $19 once, for one full search. Nothing renews.
• ·Pro: $39 a month, or $372 a year, for 10 full searches in every month of the subscription. Renews automatically until you cancel.

Searches you paid for do not expire while your account exists; unused Pro searches carry over. A search that fails on our side gives the search back automatically. Prices are shown before checkout and may be charged in euros or dollars at the same number, depending on where you buy from. We may change prices for future purchases and renewals; for a running subscription we tell you at least 30 days before the next renewal, and you can cancel before it applies.

Everything Pallas shows about a creator comes from public data at the time of the search and from automated analysis, partly by language models. Prices are estimates from published market data, not quotes. Views, scores, language and country are estimates. Contact data is what the creator published and may be outdated. Reply and booking rates we quote are industry figures, not promises. We do not guarantee that any creator replies, agrees, posts, or that a post sells anything. Check a creator yourself before you pay them.

Pallas never contacts a creator. If you do, you act in your own name and on your own responsibility. In particular:

• ·Email needs consent in some countries. In Germany, advertising email requires prior consent, also between businesses (§ 7 (2) no. 2 UWG). Other countries have similar rules (for example CAN-SPAM in the USA, CASL in Canada). Check the rules that apply to you and to the creator before you send an email. A direct message on the platform is usually the safer first contact, and it is the default in Pallas.
• ·Respect the platforms' rules for messages (TikTok, Instagram) and do not send the same message in bulk.
• ·Stop when a creator says no, or asks you not to write again. Do not follow up more than three times.
• ·Paid posts must be labelled as advertising. Tell the creator, and do not ask them to hide that a post is paid.
• ·Pay what you promise. Pallas drafts messages that promise payment up front; only send them if you mean it.

When you copy a contact, send a draft or download a CSV, you decide what happens with that data and you are the controller for it under the GDPR. You agree to:

• ·use creator data only to offer creators paid work for your own product or brand, or for a client you work for,
• ·not sell, publish or share it, and not use it to build your own creator database, for other marketing or for anything a creator would not expect,
• ·delete it when you no longer need it, and at the latest 12 months after the search,
• ·delete it right away when a creator asks you to, and not contact creators who removed themselves from Pallas (/creators),
• ·answer creators' data protection requests about your copy yourself.

Do not:

• ·scrape, copy or resell Pallas or its results, or access it with bots or scripts outside the web app,
• ·use it to harass, stalk, dox or pressure anyone, or to find people for anything other than a business offer,
• ·search for products that are illegal, deceptive, or harmful to minors (for example gambling, adult content, weapons, unlicensed financial products),
• ·try to get around the free-search limit, rate limits, bot checks or payment,
• ·probe, overload or attack our systems.

If you do, we may block searches or close your account. Where it is not a clear or serious breach, we warn you first. You keep paid searches you have not used, unless the breach was about payment or abuse of the free search.

Product links, budgets, notes and your do-not-contact list stay yours. You allow us to use them to run Pallas for you. Do not paste links you are not allowed to share; we fetch them on your behalf. We do not use your searches to train models.

We aim to keep Pallas running but do not promise uninterrupted availability. Searches depend on TikTok, Instagram and our data provider; when one of them is down, results can be partial, and we say so on the results page. We may pause searches for a while to protect the service. We may change features; we will not take away something you paid for in a running period without refunding the unused part.

You can stop using Pallas and ask for deletion of your account at any time. We can end a free account with two weeks' notice, and any account without notice for good cause, in particular a serious breach of sections 6 to 8. On deletion, your searches, results and notes are deleted as described in the privacy policy; data we must keep for tax reasons is kept for as long as the law requires.

We may update these terms, for example when the law or Pallas changes. For changes that affect you, we email you at least 30 days before they apply. If you object in that time, the old terms continue for your running subscription and you may cancel; if you keep using Pallas after the date without objecting, the new terms apply. We point this out in the email.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country where you live remain unaffected. If you are a merchant, the place of jurisdiction is Frankfurt am Main, Germany.

Pursuant to § 36 VSBG, we are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
